Terms of Service

1. Acceptance of Terms

By accessing or using TestForge AI ("Service"), operated by TestForge ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Service.

2. Description of Service

TestForge AI is a deploy-aware agentic QA platform that enables automated test generation, execution, and monitoring of web applications. The Service uses artificial intelligence to generate test cases from natural language descriptions and executes them using browser automation technology.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service to test applications you do not own or have explicit authorization to test
• Attempt to gain unauthorized access to any systems or networks
• Use the Service for any form of credential stuffing, brute force attacks, or unauthorized penetration testing
• Use the Service to violate any applicable laws, regulations, or third-party rights
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service in a way that could damage, disable, or impair the Service or interfere with other users

5. Subscription and Payment

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

6. API Keys and Third-Party Services

The Service may require you to provide API keys for third-party AI providers (e.g., Anthropic, OpenAI, Google). You are solely responsible for securing these keys and complying with the respective provider's terms. We do not store your API keys on our servers — they are kept exclusively in your browser's local storage.

7. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by TestForge and protected by intellectual property laws. Test cases you create using the Service are your property. We claim no ownership over your test data, configurations, or results.

8. Data Handling

We process your data in accordance with our Privacy Policy. Test execution data, including screenshots and network logs, is processed transiently and is not stored on our servers beyond the session. Your configuration data resides in your browser's local storage.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. Enterprise customers with SLA agreements are covered by separate uptime commitments.

10. Limitation of Liability

To the maximum extent permitted by law, TestForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or continuously available, or that AI-generated test cases will be complete or accurate for your specific use case.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data before account closure.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
